
क्या Cooperative Society सरकारी संस्था है? Punjab & Haryana High Court के 2026 फैसले का असली अर्थ और सहकारी क्षेत्र के लिए दूरगामी असर
सहकारी समितियों के बारे में एक आम धारणा लंबे समय से चली आ रही है—चूंकि उनका पंजीकरण Cooperative Societies Act के तहत होता है, Registrar उनकी निगरानी करता है, audit और inspection होते हैं और कई समितियां सरकारी योजनाओं के साथ काम करती हैं, इसलिए वे किसी न किसी रूप में “सरकारी संस्था” ही हैं।
Punjab & Haryana High Court के 30 जनवरी 2026 के एक महत्वपूर्ण फैसले ने इस धारणा को फिर से कानूनी कसौटी पर परखा है।
मामला Multan Singh v. State of Haryana and Others, CWP-7283-2023 का है। इसमें प्रतिवादी संस्था The Pundri Cooperative Marketing-cum-Processing Society Ltd., Pundri थी। High Court ने writ petition को maintainability के आधार पर खारिज करते हुए कहा कि कोई cooperative society केवल इसलिए Government body या “State” नहीं बन जाती क्योंकि वह Haryana Cooperative Societies Act के तहत registered है। लेकिन इस निर्णय का अर्थ यह भी नहीं है कि हर cooperative society हमेशा writ jurisdiction से बाहर रहेगी। असली सवाल उसके नाम या registration का नहीं, बल्कि सरकार से उसके वास्तविक financial, functional और administrative relationship तथा उसके द्वारा निभाई जा रही public/statutory duty का है।
यही distinction पूरे cooperative sector के लिए समझना सबसे जरूरी है।
मामला शुरू कैसे हुआ?
Multan Singh ने 1975 से अपनी सेवा शुरू की थी और 31 जुलाई 2015 को retire हुए। उनकी शिकायत थी कि retirement benefits समय पर नहीं दिए गए और आखिरकार 13 फरवरी 2018 को, लंबी litigation के बाद, भुगतान हुआ।
उन्होंने Punjab & Haryana High Court में Article 226 के तहत writ petition दायर कर देरी की अवधि के लिए 12 प्रतिशत annual interest मांगा।
उनका मूल तर्क straightforward था—retirement benefits कर्मचारी की देय राशि है; अगर employer उसे वर्षों तक रोके रखता है तो कर्मचारी को interest मिलना चाहिए।
लेकिन Pundri Cooperative Marketing-cum-Processing Society ने इससे पहले एक threshold objection उठाया:
क्या High Court Article 226 के तहत इस Cooperative Society के खिलाफ writ सुन ही सकता है?
Society ने कहा कि वह Haryana Cooperative Societies Act के तहत registered body है, लेकिन Government न तो उसका financial administration चलाती है और न उसके day-to-day functioning पर ऐसा control है जिससे उसे Constitution के Article 12 के तहत “State” माना जा सके।
High Court ने पहले इसी preliminary question को तय किया।
Court ने retirement interest पर फैसला नहीं दिया
यह इस judgment का सबसे महत्वपूर्ण हिस्सा है और headline पढ़कर अक्सर छूट सकता है।
High Court ने यह नहीं कहा कि Multan Singh को interest मिलना चाहिए या नहीं मिलना चाहिए।
Court ने merits पर कोई राय ही नहीं दी।
Justice Harpreet Singh Brar ने petition को केवल इसलिए dismiss किया क्योंकि petitioner यह establish नहीं कर पाया कि संबंधित cooperative society Government की instrumentality थी या कोई ऐसी public/statutory duty निभा रही थी जिसके आधार पर Article 226 की writ jurisdiction invoke की जा सके।
Judgment में साफ है कि dismissal “on this ground alone” हुई और interest के claim के merits पर कोई opinion express नहीं किया गया।
इसलिए इसका अर्थ यह नहीं है कि cooperative society के कर्मचारी के substantive rights समाप्त हो जाते हैं।
इसका अर्थ है कि right और remedy दो अलग कानूनी प्रश्न हैं।
किसी कर्मचारी का claim सही हो सकता है, लेकिन उसे enforce करने के लिए कौन-सा forum उपलब्ध है, यह अलग जांच का विषय होगा।
केवल registration से Government body नहीं बनती
High Court की reasoning Supreme Court के पुराने और स्थापित constitutional principles पर आधारित है।
2002 के Pradeep Kumar Biswas v. Indian Institute of Chemical Biology मामले में Supreme Court ने स्पष्ट किया था कि किसी body को Article 12 के तहत “State” मानने के लिए केवल उसकी legal form नहीं देखी जाएगी। Court को यह देखना होगा कि Government उस संस्था पर financial, functional और administrative domination रखती है या नहीं।
ऐसा control सामान्य regulatory supervision भर नहीं होना चाहिए; वह body-specific और pervasive होना चाहिए। Supreme Court ने यह भी स्पष्ट किया कि statutory regulation अपने-आप किसी संस्था को State नहीं बनाता।
यही principle cooperative societies पर भी लागू होता है।
मान लीजिए किसी society के accounts का statutory audit होता है, Registrar उसके bye-laws approve करता है, elections Act और Rules के अनुसार होते हैं और कुछ resolutions पर Registrar statutory power exercise कर सकता है। इन facts से यह जरूर पता चलता है कि society cooperative law के regulatory framework के अंदर है।
लेकिन इससे अपने-आप यह निष्कर्ष नहीं निकलता कि उसका employer Government है या society Government department का extension है।
Regulation और Government control में कानूनी अंतर है।
50 प्रतिशत Government shareholding भी अपने-आप पर्याप्त नहीं
High Court ने General Manager, Kisan Sahkari Chini Mills Ltd. v. Satrughan Nishad, (2003) 8 SCC 639 पर भी भरोसा किया।
उस मामले में Supreme Court के सामने cooperative sugar mill का प्रश्न था। State Government की significant shareholding और management में representation के बावजूद Supreme Court ने कहा कि केवल यह तथ्य निर्णायक नहीं है।
Court ने संस्था का वास्तविक character देखा—funding कहां से आती है, Government कितना administrative control करती है, business nature क्या है, monopoly है या नहीं और management structure क्या है।
Supreme Court का broader principle था कि कोई body company है, society है या cooperative society—उसका legal label निर्णायक नहीं है; Government से उसका वास्तविक संबंध निर्णायक है।
यही बात Multan Singh judgment में फिर सामने आई।
Punjab & Haryana High Court ने यह सिद्धांत 1981 में भी स्वीकार किया था
यह विचार 2026 में अचानक नहीं आया।
Punjab & Haryana High Court की Full Bench ने Pritam Singh Gill v. State of Punjab, AIR 1982 P&H 228 में करीब 45 वर्ष पहले ही कहा था कि यदि कोई registered cooperative society वास्तव में State की instrumentality या agency है, तो केवल cooperative society के रूप में registration उसे Article 226 से immunity नहीं देगा।
लेकिन उसी मामले में संबंधित Punjab State Cooperative Land Mortgage Bank को facts के आधार पर State instrumentality सिद्ध नहीं माना गया था।
इसलिए Full Bench का principle दोनों तरफ चलता है:
Registration अकेला writ के लिए पर्याप्त नहीं, लेकिन registration अकेला writ से बचाव भी नहीं है।
सब कुछ facts पर निर्भर करेगा।
Article 12 और Article 226 को एक ही चीज समझना भी गलत होगा
यहां थोड़ा constitutional distinction समझना जरूरी है।
Article 12 यह तय करने में मदद करता है कि कौन-सी body Fundamental Rights के संदर्भ में “State” मानी जाएगी।
लेकिन Article 226 की language व्यापक है। High Court कुछ परिस्थितियों में ऐसी private body के खिलाफ भी mandamus जारी कर सकता है जो Article 12 की State न हो—यदि वह public duty या statutory duty निभा रही हो और जिस action को चुनौती दी जा रही है उसमें genuine public-law element हो।
Supreme Court ने Federal Bank Ltd. v. Sagar Thomas से लेकर 2022 के St. Mary’s Education Society v. Rajendra Prasad Bhargava तक इस distinction को स्पष्ट किया है।
St. Mary’s मामले में Supreme Court ने कहा कि private institution public function कर सकती है, लेकिन इसका अर्थ यह नहीं कि उसके हर internal decision पर Article 226 लागू हो जाएगा। जिस action को challenge किया गया है उसका उस public duty से सीधा संबंध होना चाहिए। Purely private contractual service dispute, जिसमें statutory backing नहीं है, सामान्यतः writ jurisdiction में नहीं आएगा।
Cooperative sector के लिए यह distinction बेहद उपयोगी है।
किसी society का कोई particular function public nature का हो सकता है, लेकिन इससे उसके हर employee transfer, promotion, salary dispute या internal commercial decision पर writ automatically maintainable नहीं हो जाती।
Pundri Society वाला मामला क्यों हारा?
Multan Singh case में High Court ने खास तौर पर कहा कि petitioner ने यह plead या demonstrate नहीं किया कि respondent society:
State-funded थी,
State-controlled थी,
Government जैसी public function कर रही थी,
या उस particular dispute में कोई statutory/public duty enforce की जा रही थी।
दूसरी तरफ Society ने written statement में कहा कि Government का उसके financial और administrative affairs पर control नहीं है। Judgment के अनुसार यह assertion petitioner की तरफ से effectively uncontroverted रहा।
इसलिए यह case पूरे cooperative sector के बारे में एक abstract declaration से ज्यादा pleadings और evidence का lesson भी है।
यदि कोई litigant future में writ maintainability establish करना चाहता है तो उसे केवल यह नहीं लिखना चाहिए कि “society Government के control में है।”
उसे documents के जरिए दिखाना होगा कि control वास्तविक रूप से कैसा है।
किन तथ्यों से किसी दूसरी society का result अलग हो सकता है?
यही इस judgment की सबसे महत्वपूर्ण practical सीमा है।
मान लीजिए किसी दूसरी cooperative institution में Government substantial expenditure वहन करती है; management board के महत्वपूर्ण पद Government nominees के नियंत्रण में हैं; major financial या administrative decisions Government approval पर निर्भर हैं; संस्था monopoly-like statutory role निभाती है; या वह कोई ऐसी statutory/public function करती है जिसका public-law element स्पष्ट है।
तब उसका constitutional status अलग जांच मांग सकता है।
इसलिए इस फैसले को यह कहने के लिए इस्तेमाल करना उचित नहीं होगा कि:
“अब Haryana की सभी PACS, Marketing Societies, Cooperative Banks, Apex Federations या दूसरी cooperative bodies High Court के writ jurisdiction से बाहर हो गई हैं।”
High Court ने ऐसा कोई blanket rule घोषित नहीं किया।
उसने उल्टा वही established test दोहराया है कि हर संस्था को उसके factual character पर परखा जाए।
Primary PACS, district cooperative bank, marketing society और State-level apex federation की Government funding, management और functions एक जैसे होना जरूरी नहीं है।
इसलिए एक संस्था के बारे में फैसला दूसरी संस्था पर mechanical तरीके से लागू नहीं किया जा सकता।
Employees के लिए इस फैसले का क्या अर्थ है?
Employee side से यह judgment विशेष सावधानी मांगता है।
अगर employee की service conditions किसी statutory provision से governed नहीं हैं और employer society Article 12 की State नहीं है, तो केवल salary, retirement dues, promotion या service contract से जुड़ा विवाद Article 226 में ले जाना maintainability objection का सामना कर सकता है।
लेकिन इसका अर्थ यह बिल्कुल नहीं कि कर्मचारी के पास कोई remedy नहीं है।
उपलब्ध remedy dispute की प्रकृति पर निर्भर करेगी—applicable service rules, employment contract, industrial/labour law, civil remedy या किसी specific statutory mechanism की भूमिका हो सकती है।
यहां Haryana Cooperative Societies Act का एक महत्वपूर्ण पहलू भी ध्यान देने योग्य है।
Section 102 सामान्यतः society के constitution, management या business से जुड़े specified disputes को Registrar के arbitration mechanism में भेजता है, लेकिन वर्तमान provision में paid servant के disciplinary action और service matters को expressly exclude किया गया है। इसलिए employee को यह मानकर नहीं चलना चाहिए कि हर service dispute सीधे Section 102 arbitration में चला जाएगा।
यानी Multan Singh के बाद employee disputes में सही forum की पहचान और भी महत्वपूर्ण हो जाती है।
Members के मामलों में स्थिति अलग हो सकती है
Cooperative members के disputes की nature employee service disputes से अलग होती है।
Haryana Cooperative Societies Act की Section 102 member, former member, society, committee और अन्य specified parties के बीच constitution, management या business से जुड़े कई disputes को Registrar arbitration के लिए भेजती है। Section 114 में अनेक statutory orders के खिलाफ appeals का framework है, जबकि Section 128 कुछ specified matters में civil court jurisdiction को bar करता है।
इसलिए किसी member को dispute होने पर सीधे High Court जाने से पहले यह देखना जरूरी होगा कि Act ने उस dispute के लिए specific statutory remedy पहले से दी हुई है या नहीं।
Multan Singh judgment इस statutory architecture को खत्म नहीं करता।
क्या Registrar की powers अब कम हो गईं?
नहीं।
यह शायद इस judgment को लेकर सबसे बड़ी संभावित गलतफहमी होगी।
यह फैसला यह नहीं कहता कि क्योंकि cooperative society Government body नहीं है, इसलिए Registrar उस पर Haryana Cooperative Societies Act के तहत अपनी statutory powers exercise नहीं कर सकता।
Registration, audit, inquiry, inspection, elections, surcharge, certain dispute mechanisms, appeal और revision जैसी powers Act से आती हैं।
एक society का Article 12 के तहत Government body न होना और उसी society का Cooperative Societies Act के तहत regulated होना—दोनों बातें एक साथ सही हो सकती हैं। Haryana Cooperative Societies Act स्वयं Registrar को व्यापक statutory functions देता है।
इसलिए सही formula यह है:
Autonomous cooperative institution + statutory regulation = जरूरी नहीं कि Government department।
Cooperative autonomy के लिए यह फैसला महत्वपूर्ण क्यों है?
इस judgment का cooperative philosophy से भी सीधा संबंध है।
एक cooperative society मूलतः members द्वारा गठित और member-oriented institution होती है। उसका उद्देश्य यह नहीं कि वह Government department की तरह काम करे, बल्कि members की collective economic या social जरूरतें पूरी करे।
यदि केवल Government regulation के आधार पर हर cooperative institution को Government body मान लिया जाए, तो cooperative autonomy का मूल character कमजोर पड़ सकता है।
दूसरी तरफ autonomy का मतलब accountability से immunity भी नहीं है।
Act, Rules, registered bye-laws, statutory audit, Registrar की वैधानिक powers और जहां लागू हों वहां public-law obligations—ये सब society पर लागू रह सकते हैं।
इस judgment का संतुलित अर्थ इसलिए यही है:
Cooperative autonomy को Government ownership समझना गलत है, लेकिन autonomy को कानून से स्वतंत्रता समझना भी उतना ही गलत है।
इस फैसले का इस्तेमाल कैसे नहीं करना चाहिए
The Tribune ने खबर का headline दिया—“Cooperative societies can’t be treated as govt bodies.” पत्रकारिता की headline के रूप में यह फैसले का सार पकड़ती है, लेकिन legal use में इसे थोड़ा अधिक precision की जरूरत है। Tribune की report भी अंदर स्पष्ट करती है कि writ तब संभव हो सकती है जब society effectively Government-controlled हो, public duty निभाती हो या उस पर specific statutory duty हो।
इसलिए किसी Board meeting, service dispute या legal representation में केवल यह headline लिख देना पर्याप्त नहीं होगा कि:
“High Court ने कहा है cooperative societies Government bodies नहीं हैं।”
ज्यादा सही statement होगा:
Punjab & Haryana High Court ने Multan Singh मामले में held किया कि cooperative society ipso facto Article 226 writ jurisdiction के अधीन नहीं होती; Government control, State funding, public function या statutory duty जैसे factors facts और pleadings से establish करने होंगे।
कानूनी रूप से यह formulation कहीं अधिक सुरक्षित है।
पांच सवाल जिन्हें भविष्य के हर writ case में पहले पूछना चाहिए
इस फैसले से cooperative institutions के लिए एक practical test निकलता है। किसी society से जुड़े matter में High Court जाने से पहले broadly यह जांच उपयोगी होगी: Government कितना finance करती है; management पर उसका actual control कितना है; institution कौन-सा public/statutory function करती है; जिस specific action को challenge किया जा रहा है उसका public duty से direct nexus है या वह purely internal/private dispute है; और Cooperative Societies Act या किसी अन्य कानून में पहले से alternative statutory remedy मौजूद है या नहीं।
इन पांचों सवालों के जवाब ही अक्सर यह तय करेंगे कि writ jurisdiction की argument कितनी मजबूत है।
क्या यह निर्णय अंतिम nationwide law है?
Multan Singh judgment Punjab & Haryana High Court के एक Single Judge का 30 जनवरी 2026 का निर्णय है। इसका महत्व विशेष रूप से Haryana और Punjab cooperative litigation के context में है, लेकिन इसे Supreme Court judgment की तरह nationwide final pronouncement नहीं समझा जाना चाहिए।
इस judgment ने कोई बिल्कुल नया constitutional principle नहीं बनाया; मुख्यतः Supreme Court और Punjab & Haryana High Court के पहले से स्थापित principles को Pundri Cooperative Marketing-cum-Processing Society के facts पर लागू किया है।
इस लेख की तैयारी के दौरान उपलब्ध publicly searchable material में इस निर्णय को reverse करने वाला कोई reported appellate judgment नहीं मिला। फिर भी किसी litigation में इस case पर reliance करने से पहले वर्तमान case status तथा किसी LPA/SLP की स्थिति certified court record से verify करना उचित होगा।
निष्कर्ष: headline से आगे इस फैसले को समझना जरूरी है
Multan Singh judgment cooperative sector को एक जरूरी constitutional distinction याद दिलाता है।
Cooperative Society का Haryana Cooperative Societies Act के तहत registered और regulated होना अपने-आप उसे Government department, Article 12 “State” या हर मामले में Article 226 के अधीन public authority नहीं बनाता।
लेकिन दूसरी तरफ “Cooperative Society” का label भी उसे writ jurisdiction से हमेशा के लिए बाहर नहीं करता।
यदि facts दिखाते हैं कि Government संस्था को financially, functionally और administratively dominate करती है, या body public/statutory duty निभा रही है और challenged action में public-law element मौजूद है, तो writ maintainability का result अलग हो सकता है।
इसलिए इस फैसले का सबसे उपयोगी संदेश शायद यही है:
सहकारी संस्था का कानूनी चरित्र उसके नाम से नहीं, उसके वास्तविक control, funding, functions और उस particular dispute की nature से तय होगा।
Employees के लिए lesson है—पहले सही remedy और forum पहचानिए।
Boards और management के लिए lesson है—autonomy का अर्थ Government department होना नहीं है, लेकिन statutory compliance से स्वतंत्र होना भी नहीं।
और Government तथा Registrar के लिए lesson है—cooperative regulation और cooperative ownership/control के बीच की constitutional सीमा को स्पष्ट बनाए रखना जरूरी है।
लंबे समय में यह distinction ही सहकारी संस्थाओं की autonomy और accountability—दोनों को साथ बचाने में सबसे उपयोगी हो सकता है।
